Hugh Baxter died 1830Does anyone have a photocopy of the original Will of Hugh Baxter who died in 1830?
Joyce Otterstrom is about to update the "Park" database with new information about the Baxter line, but this has thrown up an anomaly which I would like to try and resolve.

Hello Bez
I've got the original somewhere, Joyce sent it to me in the mail.
Here's my transcription, I'll see if I can find where I put the original.
The last Will and Testament of me
Hugh Baxter of North Meols in the County
of Lancaster made published and declared
this twenty fourth day of July one thousand
eight hundred and thirty first. I order and direct
all my just debts funeral expences and the
charges of the probate and execution of this my
Will to be paid and discharged as soon after my
death as conveniently may be. I give and devise (?)
to my Wife one Bay where I live to the cleaths (?) hedge after
her death I give the same to my Son Thomas paying to
my Son Robert Ten Shillings yearly. I give to my
Son James the house where James Wright lives paying
to my son Robert yearly the sum of Ten Shillings.
Two Bay I give to my Son John at the south end
paying to Robt ten Shillings yearly and the south end
of the Garden I give to my Son Thomas from the
Hedge to the end of the Garden. I order that all my
all my Sons pay yearly to share and share a.....ts
the Daughter of mine Mary Collier. I order my Sons
to pay her the Sum of Ten Shillings for two
years apiece or till Three Pounds is paid to her.
I give to my Daughter Margaret the House
where she lives. I give my cow to my sons John and
James if she is in being at my Death.
Lastly I nominate and appoint my Sons John
and James my Executors of this my last Will
and Testament. Signed sealed in his presence
Hugh (x his mark) Baxter
and in the presence of each other
Richard Rymer his mark
Edward Rymer
On the fifth day of February 1831 John &
James Baxter executors in this Will were sworn in etc.
(the rest is in a different hand and not easy to read, but it seems to say that Hugh Baxter's assets amounted to less than twelve pounds).
(Signed) W Ford Surrogate.
The testator died on the fourth of December 1830 dated February 1831

Well, Steve, here's the problem - according to the transcripts of the Parish registers he was buried on the 26th November 1830, which is 8 days before the date of death according to that Will. Either it's a different Hugh Baxter, or one of the dates is wrong.
Have you any suggestions?

Yes, I hadn't noticed that. It does seem a bit odd.
It'd help if I had found his gravestone, but I haven't come across it yet (if it still exists).
I'm off on holiday on Monday, I need to have a proper look at this line but it'll have to wait until I get back.

Does it not say that he wrote his will on " twenty fourth day of July one thousand eight hundred and thirty first. " - I would take that as 1831 - or does the thirty first year mean 1830? I'm not well up on reading this old stuff, hence my nickname 'Confused of Crossens'

Yes, my fault that one.
I think it should read "The last Will and Testament of me
Hugh Baxter of North Meols in the County
of Lancaster made published and declared
this twenty fourth day of July one thousand
eight hundred and thirty. First I order and direct
all my just debts funeral expences..." etc.

Just received an email from Joyce Otterstrom regarding the Baxter lines which have now been updated:
Dear Beryl,
I just updated my Park files on Root's Web, Gen Cir, and the LDS Church
site. The LDS church site though usually won't get the update processed for about six months. I wish I could say that all errors are fixed but at least there may be fewer unless of course if I added some more.
Thanks for offering to let the forum know. Joyce
However, I have just looked at the page and there is still an error on it.

I've just re-read the updated pages and it's me being thick and forgetting who was who.
They look fine to me - I just got confused because there is nothing on Hugh Baxter's page to say his second wife was a widow - you have to click on her name to get the details.

Hello All
I'm looking for a Robert Baxter - father of John Ball, born 1848. Is it possible that Hugh's son might be the culprit? Is there any way I can have a look at Hugh's family? I can't get to any churches etc as I live in France.
Thanks in advance
Barbara

These are the updated pages referred to in the previous correspondence.

This is the biggest and most accurate database of North Meols families available. Good Luck.
